U.S. Court of Appeals Case No: 19-1578
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Stras, Author, with Benton and Grasz, Circuit Judges]
Civil case - Civil rights. Plaintiff, a member of The Satanic Temple,
claimed that a Missouri informed-consent abortion law violates the
Establishment and Free Exercise Clauses of the First Amendment. Held:
First, the court will not permit plaintiff to plead a new claim - the law
imposes an undue burden on her right to abortion on appeal; the statute's
requirement that the woman seeking an abortion must receive a
state-authored informed-consent booklet does not violate the Establishment
Clause simply because it aligns with certain religious beliefs on when
life begins; the requirement that plaintiff certify that she had a chance
to view an ultrasound at least 24 hours prior to the procedure and that
she received the informed consent booklet does not violate her
free-exercise rights.
