U.S. Court of Appeals Case No: 19-1636
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Colloton, Author, with Shepherd and Erickson, Circuit Judges]
Criminal case - Sentencing. The district court did not err in imposing a
two-level enhancement under Guidelines Sec. 3C1.1 for obstruction of
justice based on its conclusion that defendant gave false testimony at the
sentencing hearing; while it would have been a better practice to make a
specific finding as to whether the testimony was on a material matter, the
record clearly establishes that the testimony was on a material matter; no
error in denying defendant's request for an acceptance-of-responsibility
reduction in light of the 3C1.1 enhancement; sentence was not
substantively unreasonable.
