Plaintiff appeals an order dismissing, on the ground of forum non conveniens, its civil action alleging breach of non-compete agreements. Held: plaintiff has accepted and submitted to Delaware state court jurisdiction and venue, and the parties agree that no actual controversy remains concerning proper venue and that the appeal is moot. Considering the equities, including the circumstances leading to the filing of the action and the public interest in public judgments, plaintiff is entitled to vacatur of the district court's dismissal order.
