U.S. Court of Appeals Case No: 19-1742
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Melloy, Author, with Kelly and Kobes, Circuit Judges]
Prisoner case - Habeas. The state appeals court's determination that the
trial court's decision to exclude evidence regarding possible other
sources for the victim's unusual sexual knowledge was not contrary to or
an unreasonable interpretation of federal law as clearly established by
the Supreme Court;the state courts reasonably balanced competing interests
and Sittner had a full opportunity to cross-exam the expert witness on
issues specifically related to his defense strategy; Sittner's trial
attorney's failure to object to the expert witness's testimony did not
deny Sittner effective assistance of counsel as the evidence given was
admissible, and an objection would have been without merit; the district
court did not err in denying Sittner a hearing on his habeas petition
based on its conclusion that the record contained all of the facts
necessary to resolve the claims and that no further evidentiary
development was required.
