[PUBLISHED] [Shepherd, Author, with Loken and Erickson, Circuit Judges] Criminal case - Criminal law. The district court did not err in denying defendant's motion to sever his trial from that of his alleged accomplice as their defenses were not logically incompatible and any alleged conflict did not, in light of the evidence, serve as the basis for the jury verdict; further, the jury was able to compartmentalize the evidence,presented; jury instructions with regard to intimidation were not plainly erroneous; after hearing evidence regarding a juror's alleged misconduct, the court dismissed the juror, and there was no evidence that the alleged instance of misconduct tainted or improperly influenced the remaining members of the jury such as to require a mistrial.
