U.S. Court of Appeals Case No: 19-2109
and No: 19-2165
U.S. District Court for the District of North Dakota - Bismarck
[PUBLISHED] [Gruender, Author, with Wollman and Kobes, Circuit Judges]
Criminal case - Criminal law and sentencing. The evidence was sufficient
to show defendant Basic participated in a conspiracy with defendant Shaw
to distribute a fentanyl analogue; the district court did not err in
calculating the drug quantity; nor did the court err in imposing a
two-level enhancement against Shaw for obstruction of justice based on
Shaw's attempt to stifle a witness's incriminating testimony.
