Civil case - ERISA. The claim that a plan participant assigned to
plaintiff was not properly exhausted; after Meadowvale Dairy rescinded
coverage to the employee, neither he nor an authorized representative
exhausted internal remedies to challenge the decision; as a result, the
employee never enjoyed a cause of action against the plan, and there was
no cause of action for plaintiff to receive from the now-deceased
employee.
