Civil case - Defamation. The complaint pleaded actual damages sufficient
to meet the $75,000 amount-in-controversy requirement; under Missouri law,
each of the statements in issue appears capable of defamatory meaning and
the opinion privilege does not render the statements inactionable at this
time; in light of the totality of circumstances and context in which the
statements were made, a reasonable factfinder could conclude that the
statements at a minimum imply an assertion of objective fact; the district
court erred in concluding plaintiffs' complaint failed to state a claim
for defamation and in dismissing the matter; reversed and remanded for
further proceedings.
