that petitioner's conviction for second-degree felony assault was a
particularly serious crime barring statutory withholding of removal; CAT
relief is also foreclosed when a petitioner has been convicted of a
particularly serious crime; concerning petitioner's request for deferral
of removal under CAT, substantial evidence supports the agency's finding
that any torture he might suffer would not be directed by or acquiesced to
by the Somali government. Judge Kelly, dissenting.
