[PUBLISHED] [Stras, Author, with Kelly and Melloy, Circuit Judges] Civil case - Election law. Plaintiff desired to make donations to candidates running for state office in 2022 and in this action she challenged Ark. Code Sec. 7-6-203(b)(1) which provides that candidates can only accept contributions withing two years of an election; the district court found this "blackout period" on donations was likely unconstitutional and issued a preliminary injunction enjoining enforcement of the provision; plaintiff had standing to bring the suit as she expressed an intention to engage in a course of conduct arguably affected with a constitutional interest, but proscribed by a statute, and that she faced a credible threat of prosecution if she made the donations; the district court did not err in determining plaintiff was likely to succeed on the merits of her claim as, at this stage of the litigation, Arkansas has not produced evidence that the black-out period furthers its anti-corruption interests.
