U.S. Court of Appeals Case No: 19-2721
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Kelly, Author, with Wollman and Stras, Circuit Judges]
Civil case - Fair Labor Standards Act. The district court did not err in
determining that the first plaintiff class - "static, single-job
paramedics" employed by the Kansas City Fire Department - were properly
being paid overtime compensation in compliance with the FLSA's overtime
provisions; the district court also did not err in determining that the
second plaintiff class - 'dual-job paramedics, cross-trained in both
firefighting an emergency medical services" - were partially exempt from
overtime pay because they have responsibility to engage in fire
suppression activities under 29 U.S.C. Sec. 203(y). Judge Stras,
concurring.
