U.S. Court of Appeals Case No: 19-2876
U.S. District Court for the District of Minnesota
[PUBLISHED] [Loken, Author, with Smith, Chief Judge, and Gruender, Circuit
Judge]
Criminal case - Criminal law and sentencing. Evidence was sufficient to
support defendant's convictions for aiding and abetting a
felon-in-possession of a firearm, as the evidence showed he constructively
possessed one of the handgun and was in joint constructive possession of
three other handguns; Rehaif claim rejected as the record leaves no
question defendant knew he was a member of the class prohibited from
possessing a firearm under 18 U.S.C. Sec. 922(g)(1), and the district
court's failure to include a Rehaif instruction did not affect his
substantial rights or seriously affect the fairness, integrity or public
reputation of the proceedings; no error in imposing an enhancement under
Guidelines Sec. 2K2.1(b)(1)A for possessing three-to-seven firearms.
