[PUBLISHED] [Erickson, Author, with Benton, and Grasz, Circuit Judges] Civil case - ERISA. With respect to the health care plan in effect in 2015, the service providers plaintiff sued did not have discretion over their compensation and were not fiduciaries for ERISA purposes because plaintiff made the final decisions regarding payment; with respect to the 2016 health care plan, only one of the sued service providers was a fiduciary; with respect to whether that service provider breached its fiduciary duties, none of the plaintiff's allegations pertain to that provider's exercise of its fiduciary duties, and plaintiff's fiduciary duty claim fails; the district court did not abuse its discretion in awarding defendants attorney fees.
