[PUBLISHED] [Kelly, Author, with Benton and Shepherd, Circuit Judges] Civil Case - Title IX, ADA, Rehabilitation Act. The district court's grant of summary judgment to the university on claims that it mishandled sexual misconduct disciplinary process and was deliberately indifferent is affirmed. Under claim of violation of Title IX, the university's limitation on Shank's participation in the adjudicatory process in the university's complaint, permitting Shank to meet one-on-one with the abuser, failing to remove posters of the abuser on campus, and not promptly finding new accommodations did not amount to deliberate indifference that was so severe, pervasive and objectively offensive that it deprived her of the educational opportunities or benefits to which she was entitled. Under the ADA and Rehabilitation Act, Shanks failed to show the university failed to provide reasonable accommodation.
