U.S. Court of Appeals Case No: 19-3094
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Loken, Author, with Shepherd and Erickson, Circuit Judges]
Criminal case - Sentencing. No error in sentencing defendant as an armed
career criminal; defendant did not object to the PSR's recitation that he
was convicted in 1997 of first degree robbery and the district court was
entitled to treat that fact as established, even if the government could
not produce the charging document; it is well-established that Missouri
first degree robbery is a violent felony under the ACCA's elements claims.
