Criminal case - Sentencing. The district court did not err in determining
defendant constructively possessed a firearm found in the car he owned and
jointly used with his wife, where the firearm had also been kept in the
couple's home where defendant had unrestricted access; further, the record
showed defendant had discharged the firearm shortly before police arrived
on a domestic disturbance call; under the circumstances defendant could
not show a reasonable probability that he would not have pleaded guilty
had he known of Rehaif.
