Civil case - Environmental law. The district court did not err in
determining that Amren violated the Clean Air Act, Missouri's State
Implementation Plan, and Amren's Rush Island Plant Title VI Permit by
performing major modifications on the boilers at the plant without
obtaining the necessary pre-construction permits, installing pollution
control technology and otherwise complying with all applicable
regulations; with respect to Amren's Labadie plant, the government never
provided notice of or alleged that the plant committed a violation of the
Clean Air Act, and the district court lacked authority to authorize
injunctive relief with respect to the Labadie plant; the district court
had jurisdiction to consider whether Amren violated the express terms of
its Title V permit for Rush Island.
