U.S. Court of Appeals Case No: 19-3421
U.S. District Court for the Western District of Arkansas
[PUBLISHED] [Chief Judge Smith, Author, with Kelly and Erickson, Circuit
Judges]
Civil case - Social Security. Substantial evidence on the record as a
whole does not support the finding that petitioner''s pain had
significantly improved to the point where she would not miss work days;
the evidence, including the medical record, supported petitioner''s
subjective complaints of disabling pain; additionally, the ALJ erroneously
discounted other physician''s opinions in reaching the conclusion and drew
improper inferences from the medical record, resulting in a residual
functional capacity finding which was not based on substantial evidence;
remanded to the district court with directions to return the case to the
agency for a new medical-improvement evaluation consistent with this
opinion.
