U.S. Court of Appeals Case No: 19-3555
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Colloton, Author, with Melloy and Kelly, Circuit Judges] Criminal case - Criminal law. For the court's earlier opinion remanding the case for further consideration of defendant's motion to suppress, see U.S. v. Traylor,840 D. App'x 894, 894-895 (8th cir. 2021). On remand, the district court was authorized to supplement its factual findings, and there was no error in finding additional facts; the totality of the circumstances added up to reasonable suspicion of drug-related activity, and the brief extension of the traffic stop to facilitate a dog sniff of the vehicle was reasonable under the Fourth Amendment. 193555U.pdf 03/25/2021 United States v. Steven Traylor U.S. Court of Appeals Case No: 19-3555 U.S. District Court for the Western District of Missouri - Kansas City
[UNPUBLISHED] [Per Curiam - Before Colloton, Melloy, and Kelly, Circuit Judges] Criminal case - Criminal law. The district court erred in determining when a drug dog arrived at the traffic stop involved in the case, and this was a plain error that affected defendant's substantial rights; while there may be another argument for extending the seizure until the drug dog arrived, it would be better for the district court to make the necessary factual findings and to resolve the issue of reasonable suspicion in the first instance; the matter is remanded for further consideration of the motion to suppress; the court retains jurisdiction over the appeal during the limited remand.
