U.S. Court of Appeals Case No: 20-1049
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Shepherd, Author, with Gruender and Benton, Circuit Judges]
Civil case - Civil rights. The district court erred in denying the
defendant police officers' motion for summary judgment based on qualified
immunity on plaintiff's Fourth Amendment claims as the reports the
officers had received provided probable cause to arrest plaintiff for
assault in the fourth degree under Missouri law; even if the officers were
mistaken that probable cause existed, that mistake was objectively
reasonable, and arguable probable cause existed, entitling the officers to
qualified immunity; with respect to plaintiff's First Amendment claim
based on retaliatory arrest, the officers were also entitled to qualified
immunity on this claim based on the existence of probable cause to arrest
plaintiff.
