U.S. Court of Appeals Case No: 20-1050
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Shepherd, Author, with Erickson and Kobes, Circuit Judges] Civil case - Civil rights. In this Section 1983 action alleging wrongful arrest and detention, the district court erred in denying defendants' motion for summary judgment based on qualified immunity; the record establishes that the officers had probable cause to arrest defendant for assault based on the victim's identification of defendant as one of his attackers, and there was no factual dispute on this issue which precluded the entry of summary judgment in defendants' favor; with respect to plaintiff's claim that the defendants wrongfully detained him, this decision was not made by the named defendants, but rather by the city prosecuting attorney; as such, plaintiff had no standing to pursue this claim against the named defendants.
