Civil case - Civil rights. On plaintiffs' claim that the district court
erred in dismissing their claim that the two law enforcement officers
defendants violated their son's Fourth Amendment rights by arresting him
without probable cause, the officers had reason to believe at the time of
the son's arrest that he had committed the crime of sexual abuse; as a
result, they had probable cause to arrest him and were entitled to summary
judgment on the Fourth Amendment claim; with respect to plaintiffs' claim
that the officers conducted a reckless criminal investigation prior to the
arrest, thereby violating their son's substantive due process rights under
the Fourteenth Amendment, nothing in the officers' statements or actions
indicate they acted recklessly, and they were entitled to summary judgment
on the claim; because the officers had probable cause for the arrest,
plaintiffs' state law claims for false arrest and malicious prosecution
fail and defendants were entitled to summary judgment on the claims.
