U.S. Court of Appeals Case No: 20-1219
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] [Erickson, Author, with Smith, Chief Judge, and Kelly, Circuit
Judge]
Criminal case - Criminal law and sentencing. Assuming for the purposes of
argument that defendant was seized after he voluntarily stopped his
vehicle, the seizure was justified under the community caretaker exception
where the officers were reasonably concerned about the welfare of
defendant's young child; the district court properly calculated
defendant's guidelines range, weighed the relevant 3553(a) factors, and
imposed a reasonable sentence.
