U.S. Court of Appeals Case No: 20-1469
U.S. District Court for the Eastern District of Arkansas - Central
[PUBLISHED] [Benton, Author, with Gruender and Stras, Circuit Judges] Criminal case - Criminal law. In prosecution for attempted enticement of a minor and travel with intent to engage in illicit sexual conduct, the district court did not abuse its discretion in excluding testimony from defendant's proposed expert that defendant was not attracted to minors and regarding the role of fantasy in chat rooms; the court need not decide whether the proposed expert testimony violated Rule 704(b)as the evidence supporting defendant's convictions was overwhelming; defendant never used a chat room and the court did not err in excluding the testimony regarding chat rooms and fantasy; evidence was sufficient to support defendant's convictions for attempted enticement of a minor through an adult intermediary.
