U.S. Court of Appeals Case No: 20-1651
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Erickson, Author, with Smith, Chief Judge, and Kelly, Circuit
Judge]
Civil case - Civil rights. In this action alleging defendant Caples used
excessive force in removing plaintiff from a college board meeting, the
district court denied defendant's motion for summary judgment based on
qualified immunity and he appeals; because material factual disputes that
are incapable of being resolved on this record are at the heart of
defendant's arguments, his appeal is dismissed for lack of appellate
jurisdiction.
