U.S. Court of Appeals Case No: 20-1708
U.S. District Court for the District of Minnesota
[PUBLISHED] [Benton, Author, with Loken and Colloton, Circuit Judges]
Civil case - Civil rights. The district court did not err in determining
that plaintiffs' section 1983 retaliation claim was barred by the six-year
statute of limitations and that their defamation and intentional
infliction of emotional distress claims were barred by the applicable
two-year statute of limitations; plaintiffs' claims accrued in 2010 when
defendants allegedly retaliated against their public criticism of the
police investigation of their family member's murder by searching their
property and naming Daniel as person of interest; plaintiffs lacked
diligence in filing, which was not prevented by invincible necessity.
