U.S. Court of Appeals Case No: 20-1806
U.S. District Court for the Eastern District of Arkansas - Pine Bluff
[PUBLISHED] [Kelly, Author, with Grasz and Kobes, Circuit Judges] Civil case - Title VII. Plaintiff failed to establish that the harassment she experienced was sufficiently severe or pervasive to alter the conditions of her employment and create an abusive working environment, and the district court did not err in granting the Army summary judgment on plaintiff's hostile work environment claim; the district court erred, however, in granting the Army's motion for summary judgment on plaintiff's claim that she was terminated in retaliation for making a sexual harassment claim as she presented enough admissible evidence to raise a genuine doubt as the legitimacy of the Army's stated motive for her termination; remanded for further proceedings on plaintiff's retaliation claim.
