U.S. Court of Appeals Case No: 20-2058
U.S. District Court for the Southern District of Iowa - Eastern
[PUBLISHED] [Colloton, Author, with Smith, Chief Judge, and Erickson,
Circuit Judge]
Criminal case - Criminal law and sentencing. The district court did not
err in determining the traffic stop was not unduly extended as the police
obtained defendant's consent within the time reasonably required to
complete the mission of the traffic stop; once officers lawfully secured
consent to the search, any delay occasioned by the search did not
constitute an unlawful extension of the search; the enhancement imposed
under Guidelines 2K2.1(b)(6) does not amount to impermissible double
counting; in any event, the district court varied downward to offset the
increase, leaving defendant no basis for complaint; the sentence, a
downward variance, was not substantively unreasonable.
