U.S. Court of Appeals Case No: 20-2142
U.S. District Court for the District of North Dakota - Western
[PUBLISHED] [Colloton, Author, with Benton and Kelly, Circuit Judges] Civil case - Attorneys' Fees. The entry of a preliminary injunction constitutes an "entry of judgment" triggering the fourteen-day deadline for filing a motion for attorneys' fees under Fed. R. Civ. P. 54; plaintiffs' motion was untimely under Rule 54 where the injunction was entered in August 2016 and the motion was filed in April 2018; the district court did not abuse its discretion in finding that plaintiffs' failure to comply with the filing deadline was the result of excusable neglect.
