U.S. Court of Appeals Case No: 20-2282
U.S. District Court for the District of Nebraska - Omaha
[PUBLISHED] [Smith, Author, with Colloton and Erickson, Circuit Judges]
Civil case - Insurance. Rule 59(e) is a proper procedural vehicle to make
an argument regarding prejudgment interest and the issue of prejudgment
interest can be raised for the first time in the motion; the district
court did not err in calculating the amount of prejudgment interest
plaintiff owed under Nebraska law; the district court did not abuse its
discretion by concluding that entire amount of defendant's claim was
liquidated and subject to prejudgment interest.
