Criminal case - Criminal law. There is no dispute that the arresting
officer's decision to tow defendant's vehicle subsequent to defendant's
arrest was reasonable under the police department's tow policy, and
evidence found during the inventory search of the vehicle was admissible;
the court did not err in finding defendant had not maintained control or
possession of the vehicle while awaiting the arrival of a tow truck; the
need to conduct an inventory search of the vehicle's contents did not
constitute a pretext for an investigatory search.
