U.S. Court of Appeals Case No: 20-2346
U.S. District Court for the Southern District of Iowa - Eastern
[PUBLISHED] [Benton, Author, with Loken and Colloton, Circuit Judges]
Civil case - Federal Tort Claims Act. Plaintiffs sued a VA radiologist in
state court, alleging various torts. The United State removed the case to
federal court and asked to be substituted for the doctor. The district
court did not err in substituting the United States for the named
defendant as the evidence showed he was acting within the scope of his
employment.
