U.S. Court of Appeals Case No: 20-2507
U.S. District Court for the Northern District of Iowa - Eastern
[PUBLISHED] [Loken, Author, with Kelly and Erickson, Circuit Judges]
Criminal case - Sentencing. The district court did not err in determining
that the COVID-19 pandemic was not an extraordinary and compelling
circumstance compelling release under the 18 U.S.C. Sec. 3582(c)(1)(A);the
district court properly looked to Guidelines Sec. 1B1.13 and its
commentary as relevant but not binding in determining whether defendant's
health conditions at the time he requested the sentence reduction were
extraordinary and compelling reasons for a reduction; the district court
did not err in weighing the 3553(a) factors in deciding not to grant a
compassionate release reduction.
