U.S. Court of Appeals Case No: 20-2775
Petition for Review of an Order of the Board of Immigration Appeals
[PUBLISHED] [Shepherd, Author, with Gruender and Benton, Circuit Judges]
Petition for Review - Immigration. Substitution of an IJ for the IJ who
heard the evidence in the matter did not violate petitioner's due process
rights as there is no due process right to a particular IJ, and there was
no evidence that the substitute IJ who issued the decision was not fair
and impartial or that she had not familiarized herself with the case
before issuing the decision; the court is without jurisdiction to review a
claim challenging the BIA's discretionary decision to deny petitioner's
request for cancellation of removal.
