U.S. Court of Appeals Case No: 20-2842
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Gruender, Author, with Arnold and Stras, Circuit Judges]
Criminal case - Criminal law. The district court did nor abuse its
discretion in declining to give defendant's proposed good faith
instruction in this wire fraud prosecution as the instructions as a whole
adequately described the intent required for conviction of a crime
requiring fraudulent intent; no error in requiring defendant to forfeit
$91,586 from his bank account as he possessed it, and the government is
not required to show whether defendant used this money for his personal
benefit.
