U.S. Court of Appeals Case No: 20-2956
U.S. District Court for the Southern District of Iowa - Central
[PUBLISHED] [Erickson, Author, with Smith, Chief Judge, and Colloton,
Circuit Judge]
Criminal case - Criminal law. The special condition of defendant's
supervised release which required him to submit to polygraph exams but
provided that the results of the exam could not be used for purpose of
revocation was not violated here because there is no evidence in the
record that the district court used any result of a polygraph examination
in deciding to revoke defendant's supervised release; the court only
considered defendant's admissions to his probation officer and another
witness's corroborating statements in deciding defendant had violated his
supervised release through contact with a minor.
