U.S. Court of Appeals Case No: 20-3046
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Erickson, author, with Loken and Kelly, Circuit Judges]
Civil case - Americans with Disabilities Act. The district court did not
abuse its discretion in determining judicial estoppel barred plaintiff's
allegations arising out of federal transportation regulations as he took a
contrary position earlier in the litigation, the district court relied on
those representations in denying defendant's motion for judgment on the
pleadings, and permitting plaintiff to now assert the position would give
him an unfair advantage in the litigation; the district court did not err
in granting defendant's motion for summary judgment on plaintiff's
meaningful access claims as his evidence was not sufficient to show that
he was denied an opportunity to access the same services as non-disabled
riders; plaintiff's notice of appeal did not include the court's order
denying his motion to amend his complaint for the fifth time, and the
court lacks jurisdiction to review the denial of this motion to amend.
