U.S. Court of Appeals Case No: 20-3056
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Colloton, Author, with Loken and Benton, Circuit Judges]
Criminal case - Criminal law and sentencing. Because the phones seized
from defendant had evidentiary value independent of the data on the
phones, an eight-month seizure of the devices before they were searched
was not unreasonable; no error in rejecting defendant's proposed
instruction on multiple conspiracies where the evidence substantially
pointed to a single conspiracy; no error in admitting evidence of
defendant's drug trafficking activity in California when the activity was
undertaken as part of the charged conspiracy; no error in calculating the
quantity of drugs for which defendant was responsible; no error in
imposing an enhancement under Guidelines Sec. 3B1.1(a) for aggravating
role in the offense; no error in imposing an enhancement under Guidelines
Sec. 2D1.1(b)(1) for possession of a firearm; no error in imposing an
enhancement under Guidelines Sec. 3C1.2 for reckless endangerment during
flight.
