U.S. Court of Appeals Case No: 20-3321
U.S. District Court for the District of Minnesota
[PUBLISHED] [Kelly, Author, with Colloton and Shepherd, Circuit Judges]
Criminal case - Criminal law. The district court did not err in finding
credible the state trooper's testimony concerning the traffic violations
which led to a stop of the vehicle; the video footage of the incident
neither confirms nor refutes the trooper's testimony, and the district
court did not clearly err in making its credibility finding; the district
court did not improperly limit defendant's cross-examination of the
trooper regarding possible misconduct in a drug training program as the
questioning would not undermine the officer's testimony regarding the
signs of drug use he saw in the vehicle and the driver.
