U.S. Court of Appeals Case No: 20-3506
U.S. District Court for the District of South Dakota - Central
[PUBLISHED] [Shepherd, Author, with Colloton and Kelly, Circuit Judges] Criminal case - Criminal law. Defendant challenges the district court's decision to admit testimony of an expert witness for the government who compared finger and knuckle creases in sexually explicit photos with photos of defendant's fingers and knuckles to give an opinion as to the identity of the person in the photos; the court need not decide whether the district court abused its discretion in admitting the testimony because any error in admitting the evidence was harmless in light of the overwhelming evidence of defendant's guilt.
