U.S. Court of Appeals Case No: 20-3582
U.S. District Court for the Northern District of Iowa - Eastern
[PUBLISHED] [Stras, Author, with Smith, Chief Judge, and Gruender, Circuit
Judge]
Civil case - Civil rights. In action alleging defendant, a police officer,
was reckless when he proceeded through an intersection and struck the
victim's car, killing him, the evidence in the case does not establish
recklessness under Iowa law; the evidence cannot show that defendant had
conscious knowledge of a dangerous situation when he proceeded through the
intersection, and the district court did not err in granting his motion
for summary judgment.
