Criminal case - Sentencing. Even if the district court misapprehended
nationwide sentencing statistics regarding career offenders, it determined
from its own, court-specific records that it did not often sentence
ordinary career offenders below the guidelines range when the offender had
"earned their stripes as a career offender" as defendant had; any error
did not substantially influence the outcome and was harmless. Judge Stras,
concurring in the judgment.
