U.S. District Court for the Western District of Missouri - Springfield
[PUBLISHED] [Gruender, Author, with Smith, Chief Judge, and Stras, Circuit
Judges]
Civil case - Contracts. Plaintiff establish two required elements of a
breach-of-contract claim - the existence of a valid contract and that the
alleged damages were caused by the breach - and defendant was not entitled
to judgment as a matter of law on plaintiffs' claim that defendant's
termination of the parties' dealership contract breached the contact; the
evidence in the case was sufficient for a reasonable jury to find there
was mutual assent as to the size and measurement of plaintiff's protected
territory; the evidence was also sufficient for a reasonable jury to
choose and apply plaintiffs' theory about the cause of the lost profits;
the evidence was also sufficient to support plaintiff's claim under
Missouri's outdoor power equipment statute - Mo. Rev. Stat. Sec. 407.895;
evidentiary challenges and claims of jury instruction error rejected;
