U.S. Court of Appeals Case No: 21-1164
U.S. District Court for the District of Nebraska - Lincoln
[PUBLISHED] [Kelly, Author, with Benton and Erickson, Circuit Judges]
Criminal case - Criminal law and sentencing. The district court did not
err in admitting evidence of drug sales by defendant's co-conspirators or
evidence concerning a pre-conspiracy sale by defendant; the evidence of
the pre-conspiracy sale was extremely close in time, identical in nature
and directly relevant for Rule 404(b) purposes; the evidence was
sufficient to support defendant's conviction for conspiring to distribute
methamphetamine; defendant's sentence was not substantively unreasonable
or disproportionate to his co-defendants' sentences.
