U.S. Court of Appeals Case No: 21-1499
U.S. District Court for the Eastern District of Arkansas - Central
[PUBLISHED] [Benton, Author, with Shepherd and Stras, Circuit Judges]
Criminal case - Restitution. The district court made no findings
concerning the source of the funds in defendant's inmate account before it
ordered him to turn over half of it as a restitution payment; as in U.S.
v. Kidd, 23 F.4th 781 (8th Cir. 2022), the record here is insufficient to
show whether the money in the account included the receipt of substantial
resources from outside sources that would be subject to turnover under 18
U.S.C. Sec. 3664(n); remanded to permit the district court to determine
the exact composition of the account balance and to determine if the
government's turnover motion is properly considered pursuant to Sec.
3664(n) or another section.
