U.S. Court of Appeals Case No: 21-1591
U.S. District Court for the District of Nebraska - Lincoln
[PUBLISHED] [Colloton, Author, with Kelly and Kobes, Circuit Judges]
Criminal case - Sentencing. The district court did not abuse its
discretion in denying defendant's motion for a First Step Act sentence
reduction; the district court did not abuse its discretion by considering
whether compassionate release would reduce defendant's risk of contracting
COVID or developing complications; nor did the court err in considering
whether defendant presented a potential danger to the public if released.
Judge Kelly, dissenting.
