U.S. Court of Appeals Case No: 21-1679
U.S. District Court for the District of Minnesota
[PUBLISHED] [Erickson, Author, with Grasz and Stras, Circuit Judges]
Civil case - Insurance. Because defendant Payday's crossclaim is so
intertwined with the original interpleader claim, the district court did
not err in exercising supplemental jurisdiction over the nonfederal
claims; the district court erred in denying plaintiff's motion to compel
arbitration because defendant Payday contends the Program Agreement
between the parties which contained the arbitration clause was superseded
by the insurance policy, thereby rendering it void; this is a challenge to
the contract's validity that must be considered by an arbitrator; the
denial of the motion to compel arbitration of the crossclaims is reversed,
and the matter is remanded for further proceedings.
