U.S. Court of Appeals Case No: 21-1729
U.S. District Court for the Southern District of Iowa - Eastern
[PUBLISHED] [Kelly, Author, with Colloton and Kobes, Circuit Judges]
Criminal case - Criminal law. Evidence was sufficient to support
defendant's convictions for possession of a controlled substance with
intent to distribute, being a felon in possession of a firearm, and
possession of a firearm in furtherance of drug trafficking; admission of
testimony from an expert witness on whether the drug in question was
possessed with intent to distribute was plain error under Rule 704(b), but
the error did not affect defendant's substantial rights in light of the
ample evidence from which the jury could conclude an intent to distribute.
