[PUBLISHED] [Gruender, Author, with Erickson and Stras, Circuit Judges] Civil case - ERISA. The defendant plan denied plaintiff's request for long-term disability benefits on the ground plaintiff retained the ability to perform sedentary work. Plaintiff sued under ERISA and the district court granted his motion for summary judgment. While the district court erred by resolving factual disputes in ruling on the motion, the error was harmless, and the district court's judgment is affirmed.
