U.S. Court of Appeals Case No: 21-1844
and No: 21-1846
U.S. District Court for the District of Nebraska - Omaha
[PUBLISHED] [Erickson, Author, with Benton and Kelly, Circuit Judges]
Civil case - Employment discrimination. Plaintiffs' conduct did not fall
within the protection of Neb. Rev. Stat. Sec. 48-1114(1)(c) as their acts
were not in opposition to any unlawful activity by defendant; assuming
without deciding that plaintiffs had established a prima facie that they
were terminated on the basis of their race, defendant articulated a
legitimate, non-discriminatory reason for their termination, and
plaintiffs failed to show the stated ground was a pretext for race
discrimination as they could not establish a similarly situated white
comparator; evidence plaintiffs contend was wrongly excluded would not
have cured the substantive defects in their claims.
